Automatic Temporary Restraining Orders (TROS)

The filing of divorce papers should not result in a mad scramble to siphon equity out of a home or to remove funds from retirement, checking and savings accounts. Divorce should also not lead spouses into frantic efforts to saddle each other with marital debt, or lead parents to make major changes that would alter the lives of their children.

To ensure that community property and community debt remains in place throughout the divorce process, California law provides for automatic temporary restraining order. Automatic temporary restraining orders protect the status quo of the marital assets and debts as soon as a divorce is filed and the other party is served. This restraining order is, as the name suggests, "automatic." Once a divorce is filed and the other party is served, both parties are legally barred from:

  • Removing minor children from the state
  • Disposing of significant property
  • Changing the beneficiaries of wills and life insurance policies
  • Engaging in a variety of actions affecting the increase or assignation of debt
