When a parent is receiving public assistance for a minor child, the county paying the aid may seek an order for child support to be paid by the non-custodial parent.  The county may also seek an order for child support to be paid by the non-custodial parent even in cases where public assistance is not placed for the child.  This occurs when the custodial parent requests for the District Attorney’s, (now called the Department of Child Support Enforcement Services) (DCSS) assistance in establishing and enforcing child support.

If the parties have never been married, the DCSS will commence an action to establish paternity. Upon establishing paternity, the DCSS will proceed to establish child support.
